International students and nonresident aliens generally cannot claim the Lifetime Learning Credit (LLC) unless they meet specific requirements to be treated as U.S. residents for tax purposes.
1. General Rule: Nonresident Aliens Are Not Eligible
- The Lifetime Learning Credit is only available to U.S. citizens and resident aliens. Nonresident aliens are not eligible to claim the LLC on Form 1040NR, even if they have U.S. source income or pay qualified tuition and related expenses to a U.S. educational institution.
- This is confirmed in IRS guidance: “If you are a nonresident alien for any part of the year, you generally cannot claim the education credits. However, if you are married and choose to file a joint return with a U.S. citizen or resident spouse, you may be eligible for the American Opportunity Credit or Lifetime Learning Credit”.
2. Exception: Election to Be Treated as a Resident Alien
A nonresident alien may claim the LLC only if:- They are married to a U.S. citizen or resident alien, and- They make an election to be treated as a resident alien for the entire tax year by filing a joint return with their spouse.
How the election works:- By making this election, both spouses are treated as U.S. residents for the entire year for income tax purposes, and the nonresident alien spouse becomes eligible for all tax benefits available to U.S. residents, including the LLC.- The couple must file a joint Form 1040, not Form 1040NR.- Both spouses are taxed on their worldwide income for the year.
3. Other Requirements for the LLC
Even if the residency requirement is met, all other eligibility rules for the LLC must also be satisfied:- The student must be enrolled at an eligible educational institution.- Qualified expenses must be paid (tuition and required fees, and for LLC, books/supplies/equipment only if required to be paid to the institution).- The taxpayer’s modified adjusted gross income (MAGI) must be below the phaseout threshold ($90,000 single, $180,000 married filing jointly for 2025).- The taxpayer cannot be claimed as a dependent on another person’s return.- The filing status cannot be married filing separately.
4. No Credit for Most International Students
- Most international students in the U.S. on F, J, M, or Q visas are considered nonresident aliens for tax purposes for their first several years in the U.S. and file Form 1040NR. They are not eligible for the LLC unless they meet the exception above.
- Students from India may claim the standard deduction under the U.S.-India tax treaty, but this does not extend to the education credits.
